Terms & Conditions:

This Agreement is a legal agreement between FreeFollowup.com (hereafter referred to as FreeFollowup)  and the Customer whose details appear in the sign-up form attached to this Agreement, (hereafter referred to as Customer).  By accepting the FreeFollowup Service, the Customer agrees to be bound by the terms of this Agreement.

IT IS AGREED AND UNDERSTOOD BY ALL PARTIES THAT:

FreeFollowup provides autoresponder Services as described in its Web Site: http://www.freefollowup.com to online customers AND the Customer desires to use such services.

NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained the parties hereto, intending to be legally bound, hereby agree as follows: 

1. The Customer accepts the right to use the FreeFollowup Services under the terms and conditions set forth in this Agreement. 
   
   

2. FreeFollowup will activate Customers, provide online control panels and services as described on FreeFollowup's web site.
   
   

3. There is NO CHARGE for the FreeFollowup Service
   
   

4. Should Customer's account be terminated, for any reason, FreeFollowup reserves the right to delete and make null and void all data, files or other information that is stored in the Customer's account, including any future options or credits. 
   
   

5. Customer shall indemnify FreeFollowup for any damages sustained by FreeFollowup from the breach by Customer of this present Agreement

6. Customer agrees that all e-mails will contain an Unsubscribe Link and a FreeFollowup Link.
   
   

7. Customer agrees to receive email from FreeFollowup regarding information that FreeFollowup deems of interest.  Customer understands that a valid email address is required for this service. FreeFollowup will NOT give your email address to any 3rd party. Any correspondence sent to you comes directly from FreeFollowup.
   
   

8. Customer shall conduct his/her business in a manner that will reflect favorably at all times on FreeFollowup, in order to maintain FreeFollowup's good name, goodwill and reputation. 
   
   

9. ALL ACCOUNTS THAT REMAIN DORMANT (USER HAS NOT LOGGED IN OR ADDED A NEW LEAD FOR 180 DAYS OR MORE) WILL AUTOMATICALLY BE DELETED FROM THE SYSTEM.  
   
   

10. All Customer applications are subject to approval by FreeFollowup.  This Agreement shall be effective from the date of its acceptance and shall remain in full force and effective for as long as there is no breech in contract or unless terminated sooner by either party.  
    
    

11. Customer agrees that FreeFollowup shall have the right to terminate the Customer's account at any time for violation or non-compliance  with this service agreement.
    
    

12. FreeFollowup endorses a ZERO-TOLERANCE spam policy!  Customers may not use this service, directly or indirectly, for spam activities or the promotion of spam related products.  Customer agrees to refrain from improper Usenet Posting, sites that promote racism or violence, or any site that FreeFollowup deems inappropriate for its audience. FreeFollowup may be used for lawful purposes only. Transmission or storage of any material in violation of any international, federal or any state law or regulation is expressly prohibited. Breech of this clause may result in immediate termination at the discretion of FreeFollowup.  
    
    

13. Custmomer will incur a charge of $100.00 per hour for the time that FreeFollowup spends on dealing with complaints and be responsible for all legal costs that may arise in such matter.  Customer may also be subject to legal action.  FreeFollowup will be the sole arbiter as to what constitutes a violation of this provision.  FreeFollowup has the right to modify these terms at any time with no prior notice.
    
    

14. Customers may not create a scenario in which FreeFollowup handles "replies" and/or undeliverable messages.  Your FreeFollowup address must be referenced in the body of your materials. It must not be used as a "reply address", "from address", or "return address".
    
    

15. FreeFollowup DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR FREE OR UNINTERRUPTED. THE SERVICE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED.  FreeFollowup WILL NOT BE RESPONSIBLE FOR ANY LOSSES, DAMAGES OR COSTS THAT YOU AND/OR YOUR BUSINESS MAY SUFFER WHEN USING THE SERVICE. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS FreeFollowup.com FROM ANY CLAIMS RESULTING FROM YOUR USE OF SERVICE. YOU EXPRESSLY AGREE THAT USE OF SERVICE IS AT YOUR SOLE RISK. NEITHER FreeFollowup, OR ITS SERVICE PROVIDERS, AGENTS, LICENSORS, EMPLOYEES SHALL HAVE ANY LIABILITY FOR ANY DAMAGES SUFFERED BY YOU OR ANY OTHER PARTY AS A RESULT OF THE USE OR MISUSE OF THE SERVICE.
    
    

16. This Agreement contains all of the terms and conditions agreed upon by the parties hereto with reference to the subject matter hereof. No other prior agreements or understandings, whether written or oral, with respect thereto, shall be deemed to exist or to bind any of the parties hereto, and all such prior agreements and understandings shall be superseded hereby. This Agreement may only be modified by FreeFollowup at its sole discretion.
    
    

17. This service agreement is governed by the laws of the United States of America.
    
    

18. These Terms and Conditions supersede all previous written, verbal or implied provisions. Use of FreeFollowup's service constitutes acceptance of these Terms and Conditions.
